A Federal High Court in Lagos has ordered the National Drug Law Enforcement Agency (NDLEA) to produce socialite and businessman Afolabi Kazeem Micheal, popularly known as KayCee Luxury, before the court following his continued detention without formal charges.
The court’s directive came after an ex parte application was filed by the socialite through his counsel, A. Labi-Lawal (SAN), under the Fundamental Rights (Enforcement Procedure) Rules 2009.
According to the application, KayCee Luxury has remained in NDLEA custody for 14 days without being formally charged or arraigned before a competent court, a situation his legal team argues constitutes a violation of his fundamental rights.
In granting the application, the court directed the anti-narcotics agency to produce the detained socialite and provide explanations regarding the circumstances of his detention.
The applicant is also seeking judicial intervention over what his lawyers describe as a prolonged detention without due process, insisting that law enforcement agencies are required to either charge suspects within a reasonable time or release them in accordance with the law.
The case is expected to test the legality of the detention and the NDLEA’s compliance with constitutional safeguards protecting the rights of citizens.
Further proceedings are anticipated as the court considers the substantive issues raised in the application and hears the agency’s response to the allegations.
